{"id":1476,"date":"2020-09-06T15:26:27","date_gmt":"2020-09-06T14:26:27","guid":{"rendered":"https:\/\/connectproperty.com\/?p=1476"},"modified":"2020-10-01T20:40:23","modified_gmt":"2020-10-01T19:40:23","slug":"new-court-fees","status":"publish","type":"post","link":"https:\/\/brand10.uk\/connect\/new-court-fees\/","title":{"rendered":"New court fees"},"content":{"rendered":"<p>On 21 March 2016, amended fees orders came into force in both the Civil and Family jurisdictions.<\/p>\n<p>In the Civil jurisdiction, the increases relate to general application fees and possession claim issue fees.<\/p>\n<p><strong>Possession claims<\/strong><\/p>\n<ul>\n<li>Fee 1.4(b) \u2013 Proceedings issued in County Court: increase from \u00a3280 to \u00a3355<br \/>\nFee 1.4(c)\u00a0\u2013 Proceedings issued via Possession Claim Online (PCOL): increase from \u00a3250 to \u00a3325<\/li>\n<\/ul>\n<p><strong>General applications<\/strong><\/p>\n<p>For the purposes of fee collection, there will now be two types of general applications in Civil:<\/p>\n<ul>\n<li>Applications made under s.3 of the Protection from Harassment Act 1997 (in effect, a type of injunction) or applications made for a payment\u00a0from Court Funds; and<\/li>\n<li>Applications for any other reason<\/li>\n<\/ul>\n<p><strong>Fee 2.4 \u2013 an application on notice, will become fees 2.4(a) and 2.4(b)<\/strong><\/p>\n<ul>\n<li>Fee 2.4(a) \u2013 an application on notice (unless fee 2.4(b) applies): increase from \u00a3155 to \u00a3255<\/li>\n<li>Fee 2.4(b)\u00a0\u2013 an application on notice: under s.3 of the Protection from Harassment Act 1997; or for a payment out of Court Funds: remains at\u00a0\u00a3155<\/li>\n<\/ul>\n<p><strong>Fee 2.5 \u2013 an application by consent or without notice, will become fees 2.5(a) and 2.5(b)<\/strong><\/p>\n<ul>\n<li>2.5(a)\u00a0\u2013 an application by consent or without notice (unless fee 2.5(b) applies): increase from \u00a350 to \u00a3100<\/li>\n<li>Fee 2.4(b)\u00a0\u2013 an application by consent or without notice: under s.3 of the Protection from Harassment Act 1997; or for a payment out of Court Funds: remains at \u00a350<\/li>\n<\/ul>\n<p><strong>Insolvency proceedings<\/strong><\/p>\n<p>The fees for applications within Insolvency proceedings are not affected by these changes.<\/p>\n<p><strong>Impact on enforcement<\/strong><\/p>\n<p>The increase in relation to on notice applications will effect applications by debtors to set aside judgments, because these are almost always heard on notice.<\/p>\n<p>Applications by debtors for a stay of execution are usually dealt with on a without notice basis so will not be affected.<\/p>\n<p>The following applications, generally made by the High Court Enforcement Officer (HCEO) will attract the higher fee rate as they are heard on notice:<\/p>\n<ul>\n<li>Applications pursuant to CPR 85 \u2013 Interpleader<\/li>\n<li>Applications for leave for sale by private treaty<\/li>\n<li>Applications for a warrant to force entry<\/li>\n<li>Applications for a summary assessment of the fees charged<\/li>\n<\/ul>\n<p><strong>The following applications are issued on a without notice basis so will not be affected:<\/strong><\/p>\n<ul>\n<li>Applications for leave to attend third party premises<\/li>\n<li>Applications for leave to waive the notice of enforcement<\/li>\n<li>Applications for exceptional costs<\/li>\n<\/ul>\n<p>Article Source:\u00a0<a href=\"http:\/\/thesheriffsoffice.com\/articles\/new-court-fees?utm_medium=email&amp;utm_campaign=The%20Sheriffs%20Office%20-%20email%20159%20Mar%202016&amp;utm_content=The%20Sheriffs%20Office%20-%20email%20159%20Mar%202016+CID_38fd508747550cd82480b8468702b24b&amp;utm_source=Email%20marketing%20software&amp;utm_term=MORE\" target=\"_blank\" rel=\"noopener noreferrer\">The Sheriffs Office<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>On 21 March 2016, amended fees orders came into force in both the Civil and Family jurisdictions.
